Terms of Service

1. The Platform

MakeHijrah provides technology and administrative tools for:

• booking paid relocation consultations;
• matching clients with available consultants;
• processing consultation payments;
• scheduling appointments;
• generating Google Meet links;
• exchanging consultation-related messages;
• recording consultant notes;
• sending service recommendations;
• managing service requests;
• providing eligible resources and giveaways.

MakeHijrah may add, change, suspend, or discontinue features where reasonably necessary, subject to existing paid obligations and applicable law.

2. Eligibility

To use the platform you must:

• be at least 18 years old;
• have legal capacity to enter an agreement;
• provide accurate information;
• use the platform only for lawful purposes.

Organizations may use the platform only through an authorized representative.

3. Accounts and Access

• public self-signup is not available;
• a client account may be provisioned after a consultation booking begins;
• access requires email OTP or magic-link authentication;
• consultant accounts are invitation-based;
• users must maintain control of their email account;
• users are responsible for activity performed through their authenticated access;
• suspected unauthorized access must be reported promptly;
• users may not access another person's account or bypass role restrictions.

MakeHijrah may suspend access where reasonably necessary to protect users, payments, data, or platform integrity.

4. Consultation Bookings

The booking flow works as follows:

• 1. The client selects a destination, consultant, and available time.
• 2. The client provides consultation details.
• 3. The platform displays the server-controlled consultation price.
• 4. Stripe authorizes the payment method.
• 5. The consultant is asked to accept the consultation.
• 6. The payment is captured only after consultant acceptance.
• 7. After capture, the appointment is confirmed and the platform creates the Calendar event and Google Meet link.

You should also be aware that:

• selecting a slot does not guarantee confirmation until consultant acceptance and successful payment capture;
• temporary holds may expire;
• availability may change;
• booking information must be accurate;
• the client is responsible for checking the displayed date, time, and timezone;
• MakeHijrah may correct obvious technical, pricing-display, or scheduling errors before confirmation.

5. Pricing and Payment

• prices and currency are shown before checkout;
• the consultation price is snapshotted by the server when the draft is created;
• payments are processed by Stripe;
• MakeHijrah does not directly store full card details;
• a temporary authorization may appear before capture;
• authorization is not the same as a completed charge;
• payment is captured after consultant acceptance;
• taxes or payment-provider charges may apply where disclosed or required;
• users authorize MakeHijrah and Stripe to process the transaction.

6. Consultant Acceptance, Decline, and Timeout

• consultants are given a limited period to accept;
• the present platform workflow uses a 48-hour acceptance window;
• when a consultant declines or fails to accept in time, the authorization may be cancelled and no capture made;
• the consultation may be placed into administrative review where intervention is needed;
• bank processing times may affect when a released authorization disappears.

7. Cancellations and Refunds

• cancellation and refund eligibility may depend on consultation status, timing, work already performed, the terms displayed during booking, any written agreement, and applicable law;
• where MakeHijrah or the consultant cannot provide a confirmed consultation, MakeHijrah may cancel, reschedule, release an authorization, or issue a refund as appropriate;
• refunds, when approved, are returned through the original payment method;
• financial institutions control final posting time;
• nothing in these Terms limits non-waivable consumer rights.

8. Consultation Nature and Disclaimers

• MakeHijrah provides informational relocation consultations and support;
• information may concern countries, communities, costs, practical relocation considerations, and available third-party services;
• content and consultations are general information, not legal, immigration, tax, investment, medical, financial, or licensed professional advice;
• users must consult appropriately qualified professionals for regulated advice;
• immigration, residency, employment, tax, housing, banking, healthcare, and government rules may change;
• users must independently verify current requirements with official authorities;
• consultants may express experience-based opinions;
• MakeHijrah does not guarantee visa approval, residency, employment, housing, business success, financial outcome, safety, religious environment, or a successful relocation;
• relocation decisions remain the user's responsibility.

9. Consultants

• consultants may be independent service providers or authorized MakeHijrah personnel;
• consultants must provide accurate profile and availability information;
• consultants must maintain appropriate professional conduct;
• consultants may connect Google Calendar solely for scheduling functions;
• consultants must protect client confidentiality;
• consultants must not misuse client information;
• consultant notes are private from clients but may be visible to authorized administrators;
• MakeHijrah may activate, deactivate, or remove consultants for operational, security, quality, or policy reasons.

10. Service Recommendations and Third-Party Services

• consultants may propose relocation-related services after a completed consultation;
• an administrator reviews and sends recommendations;
• clients see only recommendations that have been sent;
• recommended services may have separate prices, terms, providers, and payment links;
• a recommendation is not a guarantee of suitability, availability, approval, or outcome;
• third-party providers are responsible for their own services, representations, privacy practices, and contractual obligations;
• clients should review separate service terms before paying.

11. Messages and User Content

You remain responsible for the information you submit through the platform.

You grant MakeHijrah a limited, non-exclusive permission to host, process, copy, display, and transmit submitted content only as necessary to operate, secure, support, and improve the platform.

You must not submit:

• unlawful, fraudulent, threatening, defamatory, abusive, or infringing material;
• malware or harmful code;
• another person's confidential information without authority;
• false booking or identity information;
• payment-card details through messages or consultation forms;
• content that interferes with platform operation.

MakeHijrah may remove content or restrict access where reasonably necessary.

12. Acceptable Use

The following are prohibited:

• unauthorized access;
• impersonation;
• account sharing intended to bypass controls;
• scraping or automated extraction without written permission;
• probing or exploiting security vulnerabilities;
• disrupting infrastructure;
• reverse engineering except where applicable law expressly permits it;
• fraudulent bookings, chargeback abuse, or payment manipulation;
• use that violates sanctions, export controls, or applicable law;
• harassment of clients, consultants, staff, or other users.

13. Intellectual Property

The platform, branding, interface, software, text, graphics, and MakeHijrah-provided resources are owned by or licensed to MakeHijrah and protected by applicable intellectual-property laws.

Users receive a limited, revocable, non-exclusive, non-transferable right to use the platform for its intended purpose. No ownership rights are transferred.

14. Privacy

Information is handled according to the MakeHijrah Privacy Policy.

Third-party services also apply their own privacy policies.

15. Platform Availability

• the platform is provided on an “as available” basis;
• uninterrupted or error-free operation is not guaranteed;
• maintenance, outages, provider failures, security events, or circumstances beyond reasonable control may affect service;
• MakeHijrah may modify or suspend features where necessary;
• reasonable efforts will be made to preserve confirmed paid obligations or provide an appropriate remedy.

16. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the platform and its content are provided without warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, or results.

Nothing in these Terms disclaims rights or warranties that cannot legally be disclaimed.

17. Limitation of Liability

To the maximum extent permitted by applicable law, MakeHijrah and its owners, personnel, consultants, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, income, data, opportunity, goodwill, or expected relocation outcomes arising from use of the platform.

For claims directly arising from a paid service, aggregate liability will not exceed the amount paid by the user to MakeHijrah for the specific service giving rise to the claim during the six months before the event giving rise to liability.

These limits do not apply where prohibited by law, including liability that cannot legally be excluded.

18. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless MakeHijrah and its owners, personnel, contractors, and service providers from third-party claims arising from:

• unlawful use;
• violation of these Terms;
• infringement of another person's rights;
• information or content submitted by the user;
• fraud or intentional misconduct.

This obligation does not apply to the extent a claim results from MakeHijrah's own unlawful conduct.

19. Suspension and Termination

MakeHijrah may suspend or terminate access for:

• material violation of the Terms;
• fraud or payment abuse;
• security risk;
• unlawful conduct;
• harm to users or platform integrity;
• prolonged inactivity where appropriate;
• discontinuation of the service.

Termination does not erase payment, refund, confidentiality, intellectual property, dispute, or liability obligations that should reasonably survive.

20. Changes to the Terms

MakeHijrah may update these Terms for legal, operational, security, or service changes. The effective date will be updated, and material changes may be communicated through the platform or by email.

Continued use after the effective date constitutes acceptance where permitted by law. Where affirmative consent is legally required, MakeHijrah will request it.

21. Applicable Law and Disputes

These Terms are governed by applicable law. Before starting formal proceedings, you and MakeHijrah agree to make a good-faith effort to resolve the issue by contacting info@makehijrah.com. Nothing in these Terms prevents either party from seeking urgent injunctive relief or exercising non-waivable rights available under applicable consumer law.

22. Severability and Entire Agreement

• if a provision is unenforceable, it will be limited or removed only to the extent required, and the remaining provisions continue;
• failure to enforce a provision is not a waiver;
• these Terms and incorporated policies form the agreement governing platform use, except where a separate written service agreement applies;
• users may not assign their rights without MakeHijrah's written consent;
• MakeHijrah may assign the agreement as part of a restructuring or transfer of the business.
